Terms and Conditions

1. General

By accessing this Mobile App, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy govern Hungry Korean's relationship with you in relation to this Mobile App. If you disagree with any part of these terms and conditions, please do not use our Mobile App. The content of the pages of Mobile App is for your general information and use only. It is subject to change without notice.

The term "Hungry Korean" or "us" or "we" refers to the owner(s) of Mobile App, Hungry Korean stores and all of its subsidiaries situated in Hong Kong SAR. The term "you" refers to the user or viewer of our Mobile App.

2. Conditions of Use

When registering as a member, you will need to select username and password. You must keep such information confidential. Hungry Korean will not be responsible for, whether you were aware or not, any loss caused by stolen password.

Mobile App account and its services provided are only for the use of the individual Hungry Korean member. Access rights may not be transferred. Hungry Korean reserves the right to suspend this service or any part(s) of the services for repair, maintenance, upgrade or any other work Hungry Korean deems appropriate without prior notice.

If you are under 18 years of age, or considered as underage by law or do not have the ability to make a contract or are unable to bear any legal responsibility, and when using this Mobile App give(s) rise to legal obligations or responsibilities, you should not provide any personal information described herein. Should you wish to use the Mobile App, you must seek approval from your parent or legal guardian. Hungry Korean assumes that all users of this Mobile App are of legal age. Hungry Korean is not obliged to check or verify your age but if it is found that any user is under-aged, Hungry Korean reserves the right to take action against such user or his/her legal guardian, including termination of your membership.

3. Membership and Rewards

From your mobile device, supported both on Android and i-phone, download and install Hungry Korean App. Upon completion, register as first-time user by following instructions on the screen. You will be required to complete certain information fields, which will be used by Hungry Korean during manual verification process, if needed, at a later date. By using the Mobile App, you agree to keep your username and password confidential, as well as your other personal details you provide to us.

In order to earn Hungry Points, present your mobile device with QR code generated by the Mobile App that is unique to match your membership details. Presenting the QR code before making payments allows you to earn one (1) Hungry Point for every dollar ($1) spent. Hungry Points can only be earned if you make payments at Hungry Korean stores in person, by the member him or herself. This includes your spending at any Hungry Korean stores by way of “dine-in”, “takeaway” or “telephone pick-up”. For the avoidance of doubt, purchases made through third party businesses, including but not limited to delivery service companies, shall not earn any Hungry Points.

Hungry Points shall only be earned if you present your membership QR code before making payments. Hungry Korean will not accept any late claims or requests to add Hungry Points after payments have been settled. By using this Mobile App, you agree that Hungry Korean employees do not have any obligation to remind you regarding earning Hungry Points, and that you will hold our employees free from any liability. Presenting your QR code, in order to earn Hungry Points, prior to making payments is essential as it allows us to refuse any dishonest late claims.

The terms of redemption of Hungry Points, which will be offered and explained from time-to-time via Mobile App directly, may be adjusted by Hungry Korean, without prior notice, as we deem fit. Hungry Korean reserves the right to make final decision in case of any dispute.

In case of our equipment failure, such as malfunctioning of QR code scanner, you may still earn Hungry Points, by providing your membership number, before making any payments, after which our employee(s) will verify some of your personal details (such as registered date of birth, mobile number or email address). Only if such manual verification process is complete, full Hungry Points will be accumulated to your membership account. For the avoidance of doubt, if your membership QR code is not recognized by our equipment for whatever reason, or you fail to satisfactorily pass the manual verification process, no Hungry Points shall be earned either at the time of the purchase or at a late date.

In case of other technical difficulties caused by Hungry Korean stores or equipment used by us, including shop internet broadband connection failure, you may retain the original receipt and contact info@hungrykorean.com in English, within 7 calendar days from your purchase date, in order for us to add your Hungry Points manually.

One person shall open and maintain one membership account from one device at all times. You shall not use identical mobile number or email address to be used on different accounts. Any issues or disputes arising out of member’s failure to abide by the rules may result in immediate termination of your membership, without any compensation, as deem necessary by Hungry Korean.

Any inactive account that has not been used to earn or redeem Hungry Points for a period of six (6) calendar months shall expire and will be closed by Hungry Korean unilaterally. There shall be no other compensation on unused Hungry Points, if any. The affected member may re-join Hungry Korean Reward Programme by creating a new account.

4. Disclaimer and Indemnification

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Mobile App for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on this Mobile App is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this Mobile App meet your specific requirements.

This Mobile App contains material which is owned by or licensed to us. This material includes, but not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

Unauthorized use of this Mobile App may give rise to a claim for damages and/or be a criminal offence. From time to time, this Mobile App may also include links to other Mobile Apps. These links are provided for your convenience. They do not signify that we endorse other Mobile Apps. We have no responsibility for the content of the linked Mobile Apps.

Hungry Korean reserves the right to amend or withdraw this Mobile App at any time for any reason. In case of any dispute regarding the Mobile App or services provided, Hungry Korean reserves the right to make final decision. Your use of this Mobile App and any dispute arising out of such use of the Mobile App is subject to the laws of the Hong Kong SAR.

5. Personal Information and Collection Statement (“Privacy Statement”)

We respect the privacy of visitors to this Mobile App. Any personally identifiable information (the “Data”) on site is collected only for the purposes of providing requested information by members. We may also use IP addresses and other anonymous data for the purposes of maintaining and enhancing our Mobile App. Data on individuals will not be sold to any third party for marketing purposes.

If the information you provided is incomplete or incorrect, Hungry Korean will be unable to register you or continue to provide related services, in which case Hungry Korean has the right, without notice, to cancel your registrations and/or refuse to allow you to use the Mobile App. In the event of any changes to our Privacy Policy, whether required by law or otherwise, we shall post such changes on our Mobile App.

You acknowledge, agree and authorize us to retain and store Data you provide in one or more databases of Hungry Korean within or outside of Hong Kong, and to provide, disclose, allow, access and transfer such data to:
(a)Any employee of Hungry Korean and its affiliated companies who are authorised to handle such Data for the purposes of which such Data are collected;
(b)Any contractor or agent which provides administrative, telecommunication, computer professionals or other services to Hungry Korean and is engaged by Hungry Korean;
(c)Anyone that Hungry Korean has to make disclosure to in accordance with applicable local regulations and laws;
(d)Anyone who reasonably requires Hungry Korean to make disclosure in order that Hungry Korean can implement the purposes listed in this Privacy Statement.

Although Hungry Korean will use various security measures to protect your Data from unauthorised access, because of the nature of internet, Hungry Korean cannot guarantee the security on any transfer of Data. Should there be any advertisers or independent service providers on our website or Mobile App, you must read relevant privacy statement carefully thereto before you provide your data. Hungry Korean shall be indemnified against any claims relating to data misuse by such third parties.

You have right to access, amend or delete your personal Data held by Hungry Korean by writing to info@hungrykorean.com in English. If you do not wish to continue to receive any direct marketing materials via email, you can at any time send us your request to info@hungrykorean.com. Please note that if you opt out of receiving direct marketing materials, you will also not receive our discount offers or promotions offered to members.

6. Misuse of Materials

The contents of this website and/or Mobile App, including text, images, emblems, symbols, graphics, links, HTML code, trademark, software and other materials (the “Materials) are protected by copyright law, trademark law and other applicable laws of Hong Kong. All Materials are exclusive property of Hungry Korean and any unauthorised use of any Materials is an infringement under the copyright law, trademark law and other applicable laws of Hong Kong. You shall not, for any purposes whatsoever, sell, modify, copy, reproduce, re-issue, upload, download, publish, transmit, display, the Materials in any way without prior written consent of Hungry Korean.

In the event of any compensation claims by Hungry Korean, including reasonable legal costs and out-of-pocket expenses, arising from the user’s infringement of these terms or illegal behaviour, the user agrees to compensate Hungry Korean and its affiliates, owners, partners and employees and prevent them from loss.
